Terms/Conditions for Air and Tour Packages
via Kenny Tours Ltd. d.b.a. Shamrock Express
By using this site and purchasing from Shamrock Express or its subagents you agree to the Kenny Tours Ltd & Shamrock Express Terms and Conditions.

Included:
Roundtrip airfare, if airfare applies, from selected gateways, via scheduled airlines, prices are per person. Land arrangements are based on double or triple occupancy, per room and include components as shown as part of your selected tour. A supplement charge for single occupancy will apply. Bookings within 21 days of departure add $50 per person. All packages are capacity controlled and subject to price change and availability. Prices herein do not include any future government taxes or fees that may be implemented.

Not Included:
Passenger Facility Charges (PFCs) may apply depending upon the itinerary chosen. Federal Excise Tax: does apply per flight segment, if this tax is not included already in the advertised fare. A flight segment is defined as one takeoff and one landing. September 11th Security Fee: This fee will apply per flight per segment. USA or International Departure and Arrival Charges: USA or international government imposed taxes and fees may apply depending upon the itinerary chosen.

Travel Insurance for land only tours is $49.00 per person. By purchasing this insurance you may cancel for any reason up to seventy-two (72) hours prior to departure (i.e. departure date: July 04, 2009, 9:00 PM you may cancel up to July 01, 2009, 9:00 PM for a full credit of your purchase price, less the cost of your insurance premium.

Travel Insurance for air and land portion combined is $99.00. These rates are per person. By purchasing this insurance you may cancel for any reason up to three days/72 hours prior to departure (i.e. departure date: July 04, 2009, 9:00 PM you may cancel up to July 01, 2009, 9:00 PM for a full credit of your purchase price, less the cost of your insurance premium. This insurance will automatically be added to your invoice at the time of booking. You have seven days from the time of making your reservation to cancel this insurance. Cancellation of this insurance does not effect your air and or land component(s). Failure to cancel this insurance within the seven day period, the insurance will remain in effect and thereofre non refundable unless as stated under the cancellation/changes section below. Once purchased this premium is totally non refundable. This credit of your full purchase price is redeemable within 365 days from your original date of departure and can only be applied toward a Shamrock Express air and land service and if applicable a Shamrock Express packaged land component. This credit is non transferable and has no monetary value beyond the credited price. Any repurchase will be at the rate at the time of booking.

Changes are subject to a service (processing) charge of $50 per person, per each change by Shamrock Express . Change in departure date is not permitted and is considered a cancellation. and are subject to the penalties as outlined under the cancellations/changes section of the Shamrock Express "Fair Trade Contract."
Holders of Trip Cancellation Insurance by Shamrock Express Cancellation or refund process may take 4-6 weeks for Credit Voucher(s) to arrive to your address. Before any credit Voucher can be issued all travel documents issued to canceling party(s) must be returned to Shamrock Express. Cancellations received within three days will not be accepted and therefore are totally nonrefundable.

Changes: Prior to departure change is permitted for a fee specified under cancellations/changes. After departure: no changes are permitted. Tickets issued at special discounts may not be reissued to another fare type. Discounts do not apply to previously purchased tickets.

Vouchers: All Shamrock Express Vouchers will be mailed only to the “Lead Individual” agreeing to the Terms and Conditions Agreement.

YOUR FAIR TRADE CONTRACT WITH SHAMROCK EXPRESS

1. BOOKINGS AND PAYMENTS
All that is required to reserve your vacation is full payment for your airline ticket. and a payment of $200.00 per person for your land components. Late bookings often require us to incur additional costs for faxing, updating and confirming your car or hotel accommodations. Therefore, we will charge a late booking fee of $50 per person for bookings made within 21 days or less prior to departure, in addition to the price of all vacations booked.

2. AMENDMENTS AND CANCELLATIONS
If you cancel your vacation, tour type or change your departure or return date(s), the charges shown below become payable by you. Significant penalties will apply (i.e. nonrefundable and nontransferable airline tickets and tours may apply. Protect your vacation investment by purchasing Shamrock Express’ Trip Cancellation Insurance

ALL CHARGES BELOW ARE PER PERSON:
Once purchased, all air, ground and other components are totally nonrefundable.

All amendments and cancellations, if booked through a travel agent or your travel representative, must be made through this respective party, who must notify us immediately.

3. AIR CARRIERS
All air portions are aboard USA Certified air carriers.

4. AIRLINE RESPONSIBILITY
Shamrock Express issues tickets and coupons covering car hire, accommodations and other land services and facilities. The airline and or its agent will issue the respective air ticket. Neither Shamrock Express nor their respective subagents shall be held liable for loss or damage to property or injury of person caused by reason of any defect, negligence, or other wrongful act or omission by any other transportation company, hotel agency or party providing such services or facilities, strike, war, weather, quarantine, sickness, government restrictions or regulations, or any other cause beyond its reasonable control. All airlines concerned are not liable for any claim arising out of or in connection with carriage or other services or features otherwise performed or occurring in connection with this package, except as provided in the conditions of carriage for the airlines and the passenger tickets issued in conjunction with this package. Shamrock Express is not responsible under any circumstances for any psychological or emotional injury you may suffer in connection with your transportation, accommodations or any other arrangements in conjunction with this package.

5. LUGGAGE AND PERSONAL PROPERTY
When you fly to and from your destination the Airline’s Conditions of Carriage apply, some of which limit or exclude liability. Some airlines do not cover damage to soft-sided luggage. Air carrier’s maximum liability for loss, damage or delay to checked baggage is limited to $9.07 per pound up to 44 lb per ticketed passenger for international travel. All lost or damaged luggage must be reported to the airline's representative at the time of the incident and before you leave the airport.

6. PRICING
Both the selling price of your air and ground arrangements are capacity controlled. Please note the prices herein are based on the lowest promotional retail prices available at time of printing and may not be available on all departures.

7. BOOKINGS
Shamrock Express reserves the right to substitute hotels, golf courses or any other ground portion with equal or better as conditions may require.

8. FORUM SELECTION CLAUSE
All vacations are subject to the terms and conditions shown on the Shamrock Express Fair Trade Contract and your booking of the vacation is acceptance of the terms in the contract, including the procedure for resolution of disputes which must take place in the State of Maryland.

9. THIS CONTRACT IS SUBJECT TO MARYLAND LAW.

WHAT WE GUARANTEE IN RETURN

10. PRICE GUARANTEE
Our intention is to provide you with the vacation which you have selected, at the price in effect at time of booking. If for any reason (except as a result of USA or foreign government taxes, or fuel surcharges), we have to increase the price of your vacation, we will immediately inform you of these increases. Any increase by USA or foreign government taxes, fees or the carrier's fuel surcharges does not give you the right to cancel without penalty as stated under cancellations/changes. Please note that we reserve the right to re-invoice you in case of an error made in computing your price.

11. FLIGHT INFORMATION
You will be able to confirm the latest flight details at the time you make your reservation, and these details will also appear on the booking confirmation we issue when we receive your payment.

Your flight tickets, which we dispatch at least two weeks prior to departure (except for later bookings), will contain your flight information. All times are subject to change. Shamrock Express assumes no responsibility for any passengers making independent connections to these flights.

12. AMENDMENTS & CANCELLATION
In the unlikely event that a major change (involving a change of departure or return date, departure city or destination) becomes necessary, we will notify you as soon as possible. If you find the revised arrangements we offer unacceptable, you will have the option of cancellation without charge (less insurance premium) provided that you notify us within ten days of your receipt of notice of the change (or prior to departure date if notified less than ten days prior).

In the event of a change, we will try to substitute comparable services, but in the event of complete cancellation by us, our only liability will be to refund all monies paid as full vacation certificates good for one year from original travel date. Note: From time to time, due to excessive demand, your motorcoach tour will operate in reverse order. This does not constitute a major change.

13. REFUNDS
No refunds will be made for any services provided in the itinerary that you do not use. Insurance premiums are nonrefundable and nontransferable. Bookings made through travel agents or travel representatibe All communications prior to your departure, including payments, travel documents and insurance transactions, if applicable will be via your travel agent. or travel representative.

If for any reason you should lose your airline ticket and or other travel documents purchased through Shamrock Express, there will be a reissue charge for your airline ticket, hotel and car voucher. All bed and breakfast (B&B) vouchers if lost or stolen are totally no refundable. New B&B vouchers can be issued at your expense at the current rate.
If however, at a later date within 60 days of your return home,the original items are found, any refunds made by Shamrock Express will be based on the value of the original voucher issued less a $50. service fee.

14. OUR RESPONSIBILITY TO YOU
Shamrock Express has made arrangements with airlines, accommodations, car hire, motorcoach companies and other independent suppliers to provide you with the services you purchase. We have taken all reasonable steps to ensure that proper arrangements have been made for your vacation. However, we do not accept any liability for the actions or omissions of these independent suppliers, over whom we have no direct control. If you find you have any dispute with such persons, however, we will give you as much reasonable help as we can in resolving this matter.

Please understand, we cannot control such factors as weather, government actions, mechanical breakdowns, your physical, medical or mental disabilities, your failure to obtain valid travel documents or your failure to follow travel instructions.

We are not responsible for losses or damages arising from physical or emotional injury, property or other economic damage caused by such factors beyond our control. Shamrock Express not responsible for any consequential damages or monetary losses due to flight delays or other unforeseen circumstances. Shamrock Express is not responsible for any consequential, psychological or emotional damages or monetary losses due to flight delays, airline turbulence, transportation accidents or other unforeseen circumstances. Of course, we remain responsible for any negligent actions on our part.
All prices and features described herein (as well as in Shamrock Express' print advertisements and web site) are subject to change without notice. Some hotel or B&B room photographs do not necessarily depict the standard room category.

15. HANDICAPPED FACILITIES
Shamrock Express cannot guarantee the availability of wheelchairs at any airport. Wheelchair accessible rooms may be requested, but cannot be guaranteed. Standards may vary from accommodations to accommodations and country to country and are not within the control of Shamrock Express.

16. CAR RENTAL INFORMATION:
A valid USA drivers license is required. Rates herein include unlimited mileage, value added tax (V.A.T.) and Third party insurance only. Age restrictions apply to all driver(s). Additional charges payable directly to the car hire company may include: additional driver(s) fees (other than the party whose name appears on the car hire voucher) additional insurance(s), counter, location fees, children's car seats, GPS navigational system, state road tax and fuel.

18. TRIP CANCELLATION INSURANCE
Protect your travel investment with the purchase of Shamrock Express' optional TRIP CANCELLATION INSURANCE. This comprehensive plan will safeguard your travel investment against penalties due to trip cancellation only. I understand, if I purchase the Trip Cancellation Insurance, my refund for any applicable cancellation penalties will be in the form of Shamrock Express' Travel Certificates. This policy does not cover nonrefundable scheduled airline tickets or scheduled air penalty fees unless both air and land trip cancellation has been purchased.

(a)Travel Documentation: It is the passenger's responsibility to be in possession of all necessary documentation for the destination country (valid passport, visa applicable, etc.) at the time of departure. ALL AIRLINES reserve the right to deny boarding to passengers without the proper documentation. Non-US Citizens: should be especially diligent in determining their specific status/ document needs with the appropriate CONSULATES or EMBASSIES of all necessary documentation for the destination and passthrough country (valid passport, Transit Visa, etc.) at the time of departure.

(b) Cancellations/Refunds: All cancellations are subject to service (processing) penalties. Cancellation or refund process may take 4-6 weeks.

(c) Changes: After departure: no changes are permitted. Credit vouchers can only be issued for payment for a Shamrock Express land tour and for the original airline booked.. Tickets issued by Shamrock Express at special fare discounts may not be reissued at a lower fare. Discounts do not apply to previously purchased tickets.

(d) Taxes/Fees: Airfares do not include Passenger Facility Charge(s), USA or International departure and arrival fees, USA and foreign user, inspection, security or other similarly based charges, fees or taxes. See your individual invoice.

Miscellaneous: Fares are valid at time of issuing, subject to change without notice. For end user only - not for resale. Other restrictions may apply.

(e)Tickets are nonrefundable. Change is subject to PENALTY plus fare difference. Change must be requested PRIOR to flight, not after. Cancellation is subject to PENALTY specified in Cancellations/ Changes

(f) Valid travel documents including passports, visas and vaccination certificates must be carried during the entire journey.

CHECK-IN at the airline counter is required AT LEAST TWO (2) HOURS PRIOR TO EACH FLIGHT.

CHECK-IN LESS THAN 2 HOURS COULD RESULT IN CANCELLATION OF RESERVATION.

It is strongly recommended that TRAVEL INSURANCE be purchased.
TRAVEL AGENT(S) CARRY NO RESPONSIBILITY FOR PROBLEMS THAT ARE BEYOND AGENT’S CONTROL.
